An Overview of Consumer Protection Act 2019

A reconstituted Consumer Protection Bill was introduced in Lok Sabha in 2019 following the Consumer Protection Act, 1986. The new bill has indexed customer rights includes the following:

1. Protection against marketing products and services that are life-threatening.

2. A company must provide adequate information about the quality, quantity, purity, standard, and price of goods and services.

3. Consumer's access to different services and products at a competitive price.

4. Reimbursement against wrong and fraudulent trade practices and business transactions.

Penalties for misleading promotions

The CCPA can fine a company up to Rs 10 lakhs and/or two-year of imprisonment in case of misleading or false advertisement. The fine money can go up to Rs 50 lakhs, or the imprisonment may extend to five years in severe cases.

Right to file a complaint from anywhere

As per the new consumer act, consumers can file complaints from anywhere digitally, reducing the struggle of running around courts or other legal offices.

Right to seek compensation under product liability

If a consumer faces financial loss due to a defective product, the consumer can claim financial compensation by filing a complaint against the manufacturer or the service provider. The manufacturer or seller is liable to compensate if the product does comply with the warranty.
