Trademark Application Process

Trademark registration is one of the most vital steps for conducting business. Certain important steps must be followed for trademark application in India.

Stepwise Guidance for Online Trademark Application

We can apply for trademark registration for words, logo, numerals, slogan, device and, other purposes in India. Trademark registration legally allows the owner of the trademark to exclusively use the mark.

Trademark Search

Trademark search is the first and most vital step in Trademark Registration Application. The professional has to run a trademark search in the trademark database. This search will provide him with all the necessary information about the identical trademarks that have already been used by other entrepreneurs or trademark professionals. A trademark search will reveal the trademarks that are filed with the trademark registry. A trademark search can be performed through the Trademark Register Website.

Trademark Filing

After the completion of the Trademark Search, the application for trademark registration can be made. There is a prescribed manner for trademark application that has to be followed. The application for trademark registration must be filed along with the fee required for the purpose. A trademark application can be made at any one of the five Trademark Registrar Office that has jurisdiction over the State or online. A trademark application can also be made through a trademark lawyer or agent.

Trademark Application Allotment

A Trademark Application Allotment Number is issued to the professional within a couple of days after the Trademark Registration Application is filed with the Trademark Registrar. After the Trademark Registration is successful, the owner has the right to use the symbol of trademark (TM), next to the logo of the business.

Vienna Codification

The next step in Trademark Registration Application is Vienna Codification, also known as Vienna Classification. This step, established by the Vienna Agreement of 1973, is an international classification. Vienna Codification is the classification of the figurative elements of marks. The Trademark Registrar applies for the Vienna Classification to the trademark as soon as the trademark registration application is filed.

If the applicant searches for the trademark application status during this period, it will be shown as "Sent for Vienna Codification".

Trademark Examination

After the completion of the Vienna Codification, the trademark registration application is handed over to a Trademark Officer in the Registration Office for further inspection. The Registration Officer then further speculates the application and verifies if there is any problem in the same. Then the Officer in the Trademark Registrar Office issues an examination report in which he states whether the application has been approved or declined for trademark journal publication. He has the right to make his decision either way.

In case of rejection in the trademark registration application, the applicant has the right to know the reason for the objection from the Registration Officer. The trademark applicant also exercises the right to justify the objections to the Officer. If he fails to satisfy the Registration Officer with his justifications, he can also appeal to the Intellectual Property Appellate Board to look into the matter.

Trademark Journal Publication

As soon as the Trademark Registrar Officer accepts the registration application, the trademark gets published in the Trademark Journal.

The public has the right to object to any particular journal they come across in the weekly trademark journal if they believe that it is harmful to their interests. The objection has to be filed within 90 days of the publication. If not, then the trademark will be typically registered within 12 weeks.

In case of third-party opposition, the Trademark Hearing Officer will call for a hearing. Both the parties, the applicant and the opposing party, are required to attend the hearing to justify the registration or provide reasons for the objection of the application.

The Trademark Hearing Officer will listen to both the parties and judge the evidence presented. On this basis, the Officer would decide whether to accept or reject the trademark registration application. The Intellectual Property Appellate Board also has a right to challenge the decision.

Trademark Registration

The trademark registration certificate and trademark manuscript are prepared and sent to the trademark application if there are no complaints or oppositions against it. With the trademark registration certificate, the trademark is considered a registered trademark. The owner gets the exclusive right to use the mark next to the logo or trademark.
