Under Brand Name Reservation, an application is filed to reserve a proposed name for the brand. One can lodge a complaint against a brand in case the brand has failed to provide the quality or quantity, whatsoever and it has failed to serve the consumer provided the reasons are reasonable and valid. Design Protection as the name suggests is done to protect the design one has created and to authorize ownership over the same.

Section 4(4) of the Companies Act, 2013, requires reservation of name by making an application to the Registrar of Company (ROC) as- (i) the name of a proposed company; or (ii) The new name to which an existing company proposes to change its name. The procedure of making the application is listed in the index under Rule 9 of the Company (Incorporation) Rules, 2014. An application for reservation of name gets filed through Form No. INC-1 accompanied fees as provided under the Companies (Registration offices and fees) Rules, 2014.
