Negotiation is a process of dispute settlement that has no fixed rules but follows a predictable pattern. Negotiation is acknowledged to be the simplest means for redressal of disputes. Through negotiation, the parties in conflict begin their discussion without interference of any third person. The aim of negotiation is the settlement of disputes by exchange of views and issues concerning the parties and coming to a conclusion where both sides have a qin win situation.

Stages Of Negotiation

Each negotiation has its own unique features. Hence, there is no uniform pattern and exclusive method of negotiation and bargaining session.

A structured and effective approach has to be followed in order to come at a desired solution or outcome. Therefore, a few steps have to be followed in the negotiation process so that the parties with conflicting opinions and differences can come to an amicable solution.

The negotiation process includes the following stages in the following sequence:

  • Preparation
  • Discussion and conversation
  • Clarification of goals and outcomes
  • Negotiate towards a Win-Win conclusion
  • Agreement - concensus based
  • Implementation of course or plan of action

Thus, we can understand that Negotiation is considered to be an alternative dispute resolution as an informal process which helps the parties to resolve their differences through a mutual understanding and agreement.

Advantages Of Negotiation

Involves the Concerned Parties Only

The success of negotiation lies in the cases where it only involves the stakeholders and does not involve any other party as a result of which the process remains a private affair and confidential. The parties involved in the negotiation decide the subject matter, duration of process, location, papers to be referred etc.

Consensus Based

The negotiation process ensures that both the parties involved in negotiation have free will in participating and that no one is forced to engage in the process and is a mutual understanding and agreement.

No Third-Party Interference

The negotiation process involves only the parties involved and related to a particular dispute or conflict and no other person or a third party is allowed to intervene.

Improvement in Relationships

Negotiation being an informal process, effects relationships of the related parties in a positive manner. The goal of the negotiation is to reach a conclusion that will benefit both parties. So, a successful negotiation automatically adds to the scope of improvement of relations between the parties.

Disadvantages Of Negotiation

Impasse Situation

Sometimes the difference and disagreement between the parties may result in a deadlock situation. And Impasse situation occurs during the negotiation process where a party at any point of discussion is adamant and firm with their decision and thus the negotiation process cannot be carried forward.

Negative Impact on Relations

An unsuccessful negotiation affects the relations of the parties involved. This may also result in termination of business contracts leading to losses in business.

Not Every issues are Negotiable

Negotiation, unfortunately is not applicable for every matter of disputes. Some are required to be resolved using other methods as well.
