The Telangana High Court made it clear to private medical and nursing colleges which are affiliated to the Kaloji Narayana Rao University of Health Sciences that they must pay GST on the affiliation fee and inspection fee, with arrears from July 2017.
A division bench comprising Justice P. Sam Koshy and Justice Alishetty Lakshmi Narayana dismissed about 35 petitions filed by private medical colleges against the university’s GST demand notice. The university had been directed by the GST authorities to collect and deposit the GST dues from July 2017 on affiliation and inspection fee paid by private institutions.
The colleges said that certain categories of services provided by educational institutions were exempt from GST among which was collection of entrance fee and this would include the affiliation and inspection fee.
The court after considering all aspects including judgments of other High Courts was not inclined to quash the university’s demand notice.
