The Ministry of Corporate Affairs (MCA) has decided to charge extra fees on the form from July 1, 2022. The charges will be increased by 12 to 18 times.
The powers have been conferred by sections 396, 398, 399, 403, and 404, along with sections 469 (1) and 469 (2) of the Companies Act, 2013. To exercise the powers, the Central Government has notified Companies Amendment Rules, that is Registration Offices and Fees, 2022 to further amend the Companies Rules of 2014.
In the Companies Rules of 2014, item 1 constituted of Fee for filing under section 403 of the Companies Act, 2013. The Central Government has ordered a sub-item B to be substituted to section 403. Section 403(B) should mention the additional fee and higher additional fee that are applicable for delay in filing of forms. It will also contain the additional charges that will be charged for the increase in Nominal Share capitals or forms under section 92/137 of the Act.
Higher additional charges will be charged in case of delay in filing e-form INC-22. Charges will be filed for e-form PAS-3. Extra charges will be payable if there is a delay in filing e-forms two or more times in a year from the date of filing. An additional fee will not be payable if a higher additional fee is being charged.
